V listopadu 2019 jsem s firmou Rekostavby Hrušky, s.r.o, uzavřel smlouvu na rekonstrukci střechy RD v Rakousku ve výši asi 21.000 EUR a zaplatil zálohu 10.000 EUR. V únoru 2020 firma dovezla materiál bez dodacího listu. Ve smluvně dohodnutém termínu 1.3. však nenastoupila, 15.3. pak přišel zákaz vycestování z ČR kvůli koroně. Po jeho odeznění 24.4. firma zase nenastoupila a to ani po opakovaných telefonátech. 12.5. jsem firmu vyzval naposledy – buď nastoupí do 2 týdnů, nebo odstoupím od smouvy. Majitel firmy, pan Marcínek mi přes SMS začal tvrdit, že firma už není jeho, sprostě mi nadával, nakonec přestal úplně komunikovat a odkázal mě na právníka. Teprve 21.5. se ozvala jeho manželka, že rekonstrukci mohou provést až za dalších 7 týdnů. To jsem ztratil naprosto důvěru a našel si jinou firmu. 1.6. jsem vypověděl smlouvu, vyzval firmu k odvozu materiálu do 10 dnů a vrácení zálohy z důvodu neplnění smlouvy. Firma mi ještě nabídla odkup již dodaného materiálu v hodnotě 5400 EUR za přemrštěnou cenu 7017 EUR, což jsem musel odmítnout a trvat na jeho odvozu. K odvozu materiálu a vrácení zálohy se firma odhodlala až 19.6. po zásahu mého právníka. Materiál však neodvezla celý a zálohu nevrátila v plné výši. Podle smlouvy naběhlo smluvní penále za zpoždění stavby a nevyklizení staveniště, což firma kategoricky odmítla – a to i po výzvě od mého právníka. Teprve předžalobní výzva a možnost žaloby z mé strany způsobila, že firma začala v září vyjednávat o mimosoudním vyrovnání. To trvalo bezmála dva měsíce, probíhalo pouze přes právníky a teprve na začátku listopadu poslední den splatnosti jsem obdržel 2500 EUR jako kompenzaci. Závěr: sežeňte si dobrého právníka, mějte dost času a spolkněte nějakou tu nadávku.

In November 2019, I signed a contract with Rekostavby Hrušky, s.r.o for the reconstruction of the roof of a family house in Austria in the amount of about 21,000 EUR and paid a deposit of 10,000 EUR. In February 2020, the company imported the material without a delivery note. Within the contractually agreed term 1.3. however, she did not start, 15.3. then came the ban on leaving the Czech Republic because of the corona. After its disappearance 24.4. the company did not start again, even after repeated phone calls. 12.5. I called the company for the last time - either I will start within 2 weeks or I will withdraw from the contract. The owner of the company, Mr. Marcínek, started to tell me via SMS that the company was no longer his, he cursed me rudely, in the end he stopped communicating completely and referred me to a lawyer. Only 21.5. his wife said that they could do the reconstruction in another 7 weeks. I lost my complete trust and found another company. 1.6. I terminated the contract, called on the company to remove the material within 10 days and return the deposit due to non-performance of the contract. The company also offered me the purchase of already delivered material worth 5400 EUR for an exorbitant price of 7017 EUR, which I had to refuse and insist on its removal. The company decided to remove the material and return the deposit until 19.6. after the intervention of my lawyer. However, she did not take the material away and did not return the deposit in full. According to the contract, there was a contractual penalty for delays in construction and non-evacuation of the construction site, which the company categorically refused - even after a call from my lawyer. Only the pre-litigation appeal and the possibility of a lawsuit on my part caused the company to start negotiations on out-of-court settlement in September. It lasted almost two months, it only took place through lawyers, and only at the beginning of November did I receive EUR 2,500 as compensation on the last due date. Conclusion: get a good lawyer, have plenty of time and swallow some swearing.
